Re: Formal Demand for Relief – TCPA

To Whom It May Concern:

Please accept this letter as formal notice and demand arising from unsolicited telemarketing contact directed to me by or on behalf of the business that contacted you.

On or about the contact date, I received one unsolicited text message from the caller/texting number.

I contend I did not provide prior express written consent for these telemarketing contacts.

I contend these communications violated the Telephone Consumer Protection Act, 47 U.S.C. § 227, and its implementing regulations, including 47 C.F.R. § 64.1200.

I do not agree that an after-the-fact review of a website, linked report, terms of use, privacy policy, or similar page creates retroactive consent for contact already sent, waives any statutory right, imposes arbitration, or defeats claims arising from contact made in violation of federal or state law.

At this time, in an effort to resolve this matter without litigation, I hereby demand $500.00, calculated as one TCPA violation at $500.00 per violation. This demand is made in good faith based on the presently available evidence and the statutory damages available under the TCPA.

Nothing in this demand waives any right to seek additional damages, costs attorneys' fees where available, or other relief should further facts establish additional violations or enhanced liability.

If you intend to resolve this matter, please respond promptly in writing. If you do not intend to resolve it directly, please forward this matter to your legal counsel and have counsel contact me. If I do not receive a reasonable written response within thirty (30) days, I will consider all available remedies, including filing suit under the TCPA.
